"ASU created and fostered an environment that encouraged inappropriate behavior by football players, including sexual harassment of female students and other women," said Tod Schleier, an attorney for the woman.
Schleier filed a motion in court to keep her name out of the record to preserve her privacy. He filed the suit just before the statute of limitations expired.
"Rape victims have serious problems with recovery, and it took that long to make up her mind," he said. According to Schleier, "J.K." is still a student at ASU.
The university and the Board of Regents have 20 days to respond to the allegations in the complaint. The individuals named in the suit have not yet been served with copies of the lawsuit.
Schleier said that the incident, and Henderson's history of misconduct, was detailed in an investigation by ASU's Department of Public Safety. That file was forwarded to the Maricopa County Attorney's Office, which declined to prosecute the case.
According to County Attorney spokesman William FitzGerald, his office determined that there was "no reasonable likelihood of conviction" based on information provided.
